Rule Nisi²

June 12th, 2022 at 9AM

¹ An indictment formally charges a person with a criminal offense.  The indictment enables a government prosecution of a suspected criminal actor for the offenses charged in the indictment.  During an indictment proceeding, a grand jury determines that there is an adequate basis for bringing criminal charges against a suspected criminal actor.

² A Rule Nisi is an order from the court or ruling that will take effect and come into force at a future date provided certain conditions have been met.

Rule Nisi can also be viewed as a court order to “show cause”.

In other words, unless you can show cause, the court order, rule, or decree will take effect and become legally binding.

The word “Nisi” in Latin means “Unless”.

This is appropriate in the circumstances as a rule becomes a decree absolute (or rule absolute) “unless” a party is able to show cause.

Criminal History

The following criminal history has been found in public records from across the state.

Criminal Information

Coweta County

Richardson, with 3 other people, was arrested on Theft by Shoplifting charges.

Richardson, along with the other suspects, was indicted on 9/4/2018. They were to be arraigned on 9/19/2018.

After missing court on the 19th of September, a Bench Warrant was issued for Richardson.

Richardson was arrested and given a court date of 11/13/2018. At that court date, Richardson entered a negotiated guilty plea. The result of that plea was for her to be on probation for 8 years and pay a fine of $500.

On 1/28/2022 Probation petitioned the court to revoke her probation, citing the following: That the probationer “failed to report as instructed 6/28/2019 or anytime thereafter,” that she “is in arrears $1628.00 in court fines and fees and has never made a payment since being sentenced,” as well as getting new charges in Coweta in reference to her part in the Murder of Patrick Ballew.

She was arrested on January 10th, 2022 for the charges in the murder case, and has been sitting in jail without bond on that case ever since. She has petitioned for bond on both this case and the murder case.
